This particular area, more than any other area of family law, tends to carry with it strong feelings and adamant positions from either or both parent. Children can suffer the most from a divorce, and this is where choices need to made with clear empathy and due consideration for what is in their best interest.
Sadly, not all mothers or fathers can be good parents. Despite loving their children dearly, a spouse may be well meaning but inadequate in their role, or may have a severe flaw rendering them incapable of rearing a child alone. They may also have no real interest in being a parent other than it being an expectation of society, or their parents originally having pressured them to have children. Such a parent can be neglectful, despite love for their children.
Worst case scenario, your spouse may be physically or verbally abusive, and granting them any sort of custodial role would be damaging to the well-being of the children. Even if your spouse is not abusive, they may be hostile due to the marriage disintegrating and may want to use the children to hurt you. They may even use your children as leverage to make you give up money or property you are entitled to.
Subsequently, the question custody can easily be the most hurtful and stress-inducing part of the whole proceeding, and may even continue long after the divorce has been finalized. Your children’s future and care is the most important thing to not only you, but to us as well.
